Section 184 – Enforced Subject Access
It is concerning some police constabularies, with specialist disclosure departments addressing Subject Access Requests (SAR), otherwise referred to as ‘Right of Access’ (RoA) requests, jump to threats of ‘criminal activity’ when presented a SAR by a Third Party, such as an insurer.
Ignorance or the law, recklessness or intentional intimidation designed to cause the requestor to desist?
However, despite raising the spectre of criminality associated with such an approach, no constabulary has conveyed the action to the ICO – read more here. The ICO’s s.184 check list can be found here.
16/07/2025 the ICO find ‘no offence’ and instructs a constabulary to disclose information.
